1. Agreement to Terms
These Terms of Service ("Terms") govern your use of Find The Fun Tri-Cities (the "Site"), operated by Ikon Marketing Group LLC, doing business as FindTheFun and FindTheFun Tri-Cities ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Description of Service
Find The Fun Tri-Cities is an events discovery platform serving the Tri-Cities area of Washington State. We connect local venues with people looking for things to do, including trivia nights, karaoke, comedy shows, DJ events, happy hours, sports viewing, tastings, and activity events.
Important: This platform does not list local live band performances. Those events are exclusively handled by our friends at tricityvibe.com. Venue operators agree not to submit local live band performances through this platform.
3. User Accounts
You may create an account as either a venue operator (to submit and manage event listings) or a consumer (to save events and receive reminders). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used inappropriately.
4. Event Listings — Venue Operators
By submitting an event listing, venue operators agree that:
- All submitted information is accurate, complete, and not misleading
- They have the right to promote the event
- The event does not involve local live band performances
- Submitted images do not infringe on any third-party copyrights
- Events comply with all applicable local, state, and federal laws
- They will promptly notify us if an event is cancelled or significantly changed
We reserve the right to reject, edit, or remove any listing at our sole discretion without refund if it violates these Terms or our content standards.
5. Listing Tiers and Payments
Event listings are available in three tiers: Free, Early Bird ($8), and Featured ($20). Recurring event generation is included with Early Bird and Featured tiers at no additional charge. All prices are in USD and subject to applicable Washington State sales tax.
Visibility windows:
- Free listings go live 7 days before the event date
- Early Bird listings go live 14 days before the event date
- Featured listings go live 30 days before the event date
Refund Policy: All sales are final. We do not offer refunds for paid listings once approved and live. If an event is cancelled after a paid listing goes live, the listing fee is non-refundable. If we reject a paid submission, a full refund will be issued within 5-10 business days.
Payments are processed by Stripe. By submitting payment, you agree to Stripe's Terms of Service.
6. SMS Messaging Program
Program name: Find The Fun Tri-Cities Event Reminders
Description: Opted-in subscribers receive SMS text message reminders and promotional messages for events on Find The Fun Tri-Cities. Message frequency varies based on saved events and reminder preferences set by the user.
How to opt in: Users may opt in to SMS messages by providing their mobile phone number and checking the opt-in checkbox during account registration at findthefuntricities.com/account/signup or at any time from their account preferences at findthefuntricities.com/account/preferences. The opt-in checkbox states: "I agree to receive SMS event reminders and promotional messages from Find The Fun Tri-Cities. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help." SMS consent is not a condition of creating an account or making any purchase.
Opt-in confirmation message: "FindTheFunTricities: You're now subscribed to event reminders for the Tri-Cities, WA area! Msg & data rates may apply. Msg frequency varies. Reply HELP for help, STOP to cancel."
Message and data rates may apply. Contact your wireless carrier for details.
To opt out: Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message at any time. You will receive one confirmation message and no further messages will be sent. You may also opt out at any time from your account preferences at findthefuntricities.com/account/preferences.
To opt back in: Reply START, SUBSCRIBE, or YES.

Supported carriers include but are not limited to: AT&T, Verizon, T-Mobile, US Cellular, and other major US carriers. Carrier support may vary.
7. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent event information
- Use the Site to spam or harass other users
- Attempt to gain unauthorized access to any part of the Site
- Use automated tools to scrape or collect data from the Site
- Submit events for local live band performances
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
8. Intellectual Property
The Site and its original content, features, and functionality are owned by Ikon Marketing Group LLC and are protected by applicable intellectual property laws. Venue operators retain ownership of their submitted event content but grant us a non-exclusive license to display and promote that content on the Site and in related marketing materials.
9. Disclaimer of Warranties
The Site is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Site will be uninterrupted, error-free, or that event information will always be accurate. Event details are provided by venue operators and we are not responsible for errors or changes to events after listing.
10. Limitation of Liability
To the fullest extent permitted by law, Ikon Marketing Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or reliance on any event listing. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Benton County, Washington.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
13. User-Generated Content & Section 230
Event listings, descriptions, images, and other content submitted by venue operators are user-generated content. Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), we are not liable as the publisher or speaker of content submitted by third-party users. We reserve the right, but not the obligation, to review, edit, or remove any content that violates these Terms or that we deem inappropriate in our sole discretion.
14. Service Availability & Force Majeure
We do not guarantee that the Platform will be available at all times. The Platform may be unavailable due to scheduled maintenance, unscheduled outages, cyberattacks, hacking, distributed denial of service (DDoS) attacks, server failures, third-party service provider outages (including but not limited to hosting providers, database services, payment processors, SMS carriers, and email services), internet disruptions, natural disasters, acts of God, government actions, pandemics, or any other cause beyond our reasonable control (collectively, "Force Majeure Events"). We shall not be liable for any loss, damage, or inconvenience arising from Platform unavailability due to Force Majeure Events or any other cause. We will make reasonable efforts to restore service promptly but make no guarantee of uptime, response time, or data preservation in the event of a service disruption.
15. Indemnification
You agree to indemnify, defend, and hold harmless Ikon Marketing Group LLC and its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: your use of the Platform; your violation of these Terms; any content you submit to the Platform; your violation of any third-party rights; or your attendance at or organization of any event listed on the Platform.
16. Washington Consumer Protection Act
We are committed to full compliance with the Washington Consumer Protection Act (RCW Chapter 19.86). We strive to ensure all descriptions of our services are accurate and non-deceptive. If you believe we have engaged in any unfair or deceptive practice, please contact us at craig@heateg.com so we can address your concern before any formal action is pursued.
17. Dispute Resolution & Arbitration
Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation by contacting craig@heateg.com. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Benton County, Washington under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.This does not affect your rights under the Washington Consumer Protection Act.
18. Venue Agreement
Venue operators and event organizers are also subject to our Venue Agreement, which supplements these Terms with specific provisions governing event listings, content standards, payments, and venue conduct. By registering as a venue, you agree to both these Terms and the Venue Agreement.
