Venue Agreement

1. Eligibility

To list events on Find The Fun Tri-Cities, you must be a legitimate business, venue operator, or event organizer operating in or around the Tri-Cities area of Washington State. You must be at least 18 years of age and legally authorized to enter into binding contracts. You represent that your venue or event complies with all applicable federal, state, and local laws, including liquor licensing, occupancy regulations, ADA compliance, and health and safety requirements.

2. Listing Accuracy & Responsibility

You are solely responsible for the accuracy and completeness of all event information you submit, including:

• Event title, date, time, and location
• Event description and any promotional claims
• Age restrictions and admission requirements
• Ticket pricing and availability
• Event graphics and images

You agree to update or request removal of listings if event details change or the event is cancelled. We are not responsible for User losses arising from inaccurate or outdated event information.

3. Content License & Ownership

By submitting event content you grant Ikon Marketing Group LLC a non-exclusive, royalty-free, perpetual, worldwide license to display, reproduce, and distribute that content on the Platform and in related marketing materials. You retain ownership of your content and warrant you have all necessary rights to grant this license and that your content does not infringe any third-party intellectual property rights.

4. Prohibited Events & Content

The following are not permitted on the Platform:

• Local live band or concert performances (please use tricityvibe.com)
• Events promoting illegal activity
• Gambling events not authorized under Washington State law
• Adult entertainment events
• Events that discriminate on the basis of any protected class under Washington law
• Fraudulent or misleading event listings
• Pyramid schemes, MLM events, or investment solicitations

We reserve the right to reject or remove any listing at our sole discretion without refund if it violates these standards.

5. Review & Approval

All event submissions are subject to review and approval before going live. We aim to review within 24 hours on business days. Approval is at our sole discretion. Rejection does not entitle you to a refund of any listing fee paid.

6. Listing Fees & Payment Terms

• Free: $0 — goes live 7 days before, date-sorted
• Early Bird: $8/event — goes live 14 days before, above free listings
• Featured: $20/event — goes live 30 days before, pinned to top of category

Washington State sales tax applies to all paid listings. All payments processed securely by Stripe. Listing fees are non-refundable once approved. If your event is rejected, your payment will be refunded in full within 5-10 business days.

7. Recurring Events

Recurring event generation is available exclusively on Early Bird and Featured tier listings. You remain responsible for updating or cancelling individual occurrences if the event schedule changes. We are not liable for inaccuracies in auto-generated future event listings if you fail to notify us of schedule changes.

8. Sponsorships

Sponsorships are monthly recurring subscriptions billed by Stripe. You may cancel at any time by contacting craig@heateg.com. Cancellation takes effect at end of the current billing period with no partial refunds. We reserve the right to remove sponsorship placement for content that violates these Terms without refund.

9. Venue Profile Pages

Your venue profile page is provided free for an initial three-month trial. Continued access after the trial requires an annual subscription of $60. Your profile will be deactivated if not renewed. We are not liable for any business impact resulting from profile deactivation following non-renewal.

10. Service Availability

The Platform may be unavailable due to maintenance, outages, cyberattacks, third-party service provider failures, or other causes beyond our reasonable control. We are not liable for any losses arising from Platform unavailability. Paid listing fees are not refunded due to temporary service interruptions unless the Platform is unavailable for more than 7 consecutive days, in which case a prorated credit may be issued at our discretion.

11. Venue Conduct & Legal Compliance

You agree to operate your venue and events in full compliance with all applicable laws including Washington State liquor control laws (RCW Title 66), health and safety regulations, ADA requirements, and local ordinances. You are solely responsible for obtaining all necessary permits and licenses. Any fines, penalties, or legal proceedings arising from your events are your sole responsibility.

12. No Agency or Partnership

Nothing in this Agreement creates any agency, partnership, joint venture, or employment relationship between you and Ikon Marketing Group LLC. You are an independent third party. We have no control over your events and bear no responsibility for their conduct, safety, or outcome.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ikon Marketing Group LLC and its officers, directors, employees, agents, and successors from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys fees) arising out of or relating to: your event listings or content; the conduct of your events; your violation of any law or regulation; any injury, death, or property damage occurring at your events; or your breach of this Agreement.

14. Termination

We reserve the right to suspend or terminate your venue account and remove all associated listings at any time if you violate this Agreement, engage in fraudulent activity, or act in a manner harmful to users or the Platform. Active paid listings removed due to Terms violations are non-refundable.

15. Governing Law

This Agreement shall be governed by the laws of the State of Washington. Disputes shall be resolved as set forth in the Terms of Service, including binding arbitration in Benton County, Washington.
